On October 21, 2008, 79 members of the Mongols Motorcycle Club were taken into Federal custody after 4 Bureau of Alcohol, Tobacco, Firearms and Explosives agents infiltrated the group becoming full patch members. 110 arrest warrants and 160 search warrants were issued in California, Ohio, Colorado, Nevada, Washington, and Oregon. On October 23, 2008, U.S. District Court Judge Florence-Marie Cooper granted an injunction that prohibits club members, their family members and associates from wearing, licensing, selling and/or distributing the logo, which typically depicts the profile of a Mongolian warrior wearing sunglasses, because according to the police, they use the logo and names as an identity and as a form of intimidation to fulfill their goals. Prosecutors requested the injunction after authorities arrested dozens of Mongols under a racketeering indictment. Several civil rights groups have called foul, claiming that the actions of the judge violate due process and property rights.

The Mongols Nation is embroiled in a massive litigation battle for the right to keep wearing our patch. The Government is still pursuing the seizure of our trademarks. Judge Florence-Marie Cooper passed away on January 15, 2010 before a final ruling could be made. Any ruling in the near future will obviously set case law. The government is treading new waters in this case. There has never been a case of this caliber in U.S. history. Regardless of the ruling if it rules in our favor or in the governments favor it will naturally end up in the 9th District court of appeals. The Government has unlimited resources. The legal bills for the future seem endless for us. The Club is also asking for the return of our property, 139 motorcycles, and our patch for all non-defendants. Please help and support the Mongols M.C. were fighting the Government on this 1st Amendment Right issue so you or your club doesn't have to. No donation is too small.
